Terms of Use

Last updated: Nov 2nd 2026

1. Who we are

Smidge (playsmidge.com) is run by Omni Creative Co. ABN 64 182 070 433, based in Queensland, Australia. "We", "us" and "Smidge" mean Omni Creative Co. By using Smidge, you agree to these terms. If you don't agree, please don't use the site.

2. Using Smidge

Smidge is free to play. You don't need an account. Games run in your browser, and some save progress or your chosen character on your device.

You agree not to:

  • break, overload, scrape or reverse engineer the site
  • cheat, hack or tamper with games or play counts
  • upload or link to anything illegal, harmful or that you don't have the rights to
  • use Smidge to harass anyone or to spread malware

We can limit or block access for anyone who breaks these rules.

3. Games on Smidge

Most games on Smidge are made by independent developers, not by us. Each game belongs to its creator. We review games before they go live, but we can't promise every game is bug-free, suitable for every player or available forever. Games can be updated or removed at any time.

Some games may not suit younger players. Parents and guardians are responsible for what their kids play.

4. Submitting a game

If you submit a game, you confirm that:

  • you made it, or you have the right to share everything in it (code, art, music, fonts, models)
  • it contains no malware, hidden trackers or third-party ads
  • it doesn't break any law or anyone else's rights
  • you are 18 or over, or have permission from a parent or guardian

You keep ownership of your game. By submitting it, you give us a non-exclusive, worldwide, royalty-free licence to host it, show it, let players play it, and use its name, artwork and short gameplay clips to promote it and Smidge. This licence ends when your game is removed, except for promotional posts already published.

You can ask us to remove your game at any time by emailing hello@playsmidge.com. We'll take it down within 7 days. Founding creators may also sign a separate hosting agreement, which takes priority over this section if the two differ.

5. Our stuff

The Smidge name, logo, site design and our own games and characters belong to Omni Creative Co. Please don't copy them without asking.

6. Reporting a problem

If you think a game breaks these terms or uses your work without permission, email hello@playsmidge.com with the game's link and what's wrong. We'll look into it and remove anything that shouldn't be there.

7. No guarantees

We provide Smidge as it is. We work to keep it running, but we can't promise it will always be available, error-free or secure. Nothing in these terms limits your rights under the Australian Consumer Law or any other law that can't be excluded.

8. Liability

To the extent the law allows, we aren't liable for any indirect or consequential loss from using Smidge or any game on it, including lost progress, lost data or device issues. Where our liability can't be excluded but can be limited, it is limited to resupplying the service.

9. Changes

We may update these terms as Smidge grows, for example when we add accounts, ads or creator payments. We'll change the date at the top when we do. Using Smidge after an update means you accept the new terms.

10. Governing law

These terms are governed by the laws of Queensland, Australia.
